Terms of Service
These terms govern your use of InterSession IQ. Please read them. By creating an account or using the service you agree to them.

The legal entity name, mailing address, and support phone number in src/app/(marketing)/_components/legalContact.ts are still placeholders. Stripe checks these against the details registered on the account during activation.
1. Who we are
InterSession IQ is operated by [Legal entity name, e.g. InterSession IQ, LLC] (“we”, “us”), at [Street address], [City], [State] [ZIP], United States. The service is available at https://intersessioniq.health and its application subdomain, and through our iOS application.
2. What the service is, and what it is not
InterSession IQis software for licensed mental health professionals. It collects biometric summaries from a client's wearable device or uploaded files, organizes them alongside intake and consent information, and produces reports and alerts that help a therapist prepare for a session.
The service does not provide medical or clinical advice, does not diagnose, and is not a medical device. Reports and alerts are informational aids for a qualified clinician, not clinical determinations. Every clinical decision remains the therapist's, made with their own professional judgment. Nothing in the service is a substitute for clinical assessment.
The service is not for emergencies. It is not monitored in real time and must not be relied on to detect or respond to a crisis. If someone is in danger, call 911 or a crisis line.
3. Accounts and eligibility
- Therapist accounts are for licensed or otherwise legally qualified mental health professionals. By creating one you represent that you are qualified to practice where you practice.
- Client accounts are created only through an invitation from a therapist. Clients must be 18 or older, or have a parent or guardian act for them where the therapist's practice and applicable law allow it.
- You are responsible for keeping your credentials secure and for activity under your account. Tell us promptly if you suspect unauthorized access.
- You must give accurate account information and keep it current.
4. The therapist–client relationship
The therapeutic relationship is between the therapist and their client. We are not a party to it and we do not provide care. The therapist decides what data to collect, what to do with it, and how long the relationship continues.
Therapists are responsible for obtaining informed consent from their clients for the collection and use of biometric and health data through the service, and for complying with the professional, ethical, and legal obligations that apply to their practice. The service provides consent tooling; using it correctly is the therapist's responsibility.
Clients can withdraw consent and stop sharing data at any time. Doing so may make parts of the service unavailable to their therapist.
5. Health information and HIPAA
Where a therapist or practice is a HIPAA covered entity and uses the service to create, receive, maintain, or transmit protected health information, we act as a business associate. A Business Associate Agreement governs that relationship and, where one is in place, its terms control over these terms with respect to protected health information. 6. Your data and your content
You keep all rights in the data you and your clients put into the service. We do not sell it, and we do not use identifiable client health data to train machine learning models.
You grant us a limited licence to host, process, transmit, and display that data solely to operate the service for you, to provide support, and to meet legal obligations. That licence ends when the data is deleted.
You are responsible for having the rights and consents needed for the data you submit.
7. Acceptable use
You agree not to:
- Use the service for anything unlawful, or in a way that violates a client's rights or your professional obligations.
- Access data belonging to a therapist, practice, or client you are not authorized to access, or attempt to defeat access controls.
- Probe, scan, or test the security of the service without our written permission, or interfere with its operation.
- Reverse engineer, scrape, or resell the service, or use it to build a competing product.
- Upload malware, or content you have no right to upload.
8. Paid features, billing, and cancellation
Some features are paid monthly subscriptions. Current prices are on the pricing page. Payments are processed by Stripe; we do not receive or store full card numbers. You authorize us to charge your payment method on each renewal until you cancel.
Subscriptions renew automatically each month. You can cancel at any time from Settings, effective at the end of the current billing period. Refund and cancellation details are in the Refunds & Cancellation policy, which forms part of these terms.
We may change prices with at least 30 days' notice by email before the change applies to your subscription. Prices exclude taxes unless stated otherwise; you are responsible for any taxes that apply to you.
9. Third-party services
The service integrates with third parties you choose to connect, such as Apple Health and Oura, and relies on providers including Stripe for payments and Resend for email. Those services have their own terms, we do not control them, and we are not responsible for their acts or omissions. If a third-party integration changes or stops working, the affected features may change or stop working too.
10. Availability and changes
We work to keep the service available but do not promise uninterrupted or error-free operation. We may modify, suspend, or discontinue features. If we discontinue a paid feature you are subscribed to, we'll give you reasonable notice and refund any period you have paid for and can no longer use.
11. Suspension and termination
You may stop using the service and close your account at any time. We may suspend or terminate an account that breaches these terms, creates a security or legal risk, or has not paid amounts due, giving notice where it is reasonable to do so.
On termination, we will make your data available for export for a reasonable period and then delete or de-identify it in line with the Privacy Policy and any applicable records-retention obligations.
12. Disclaimers
Except as expressly stated, the service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that biometric data, reports, or alerts are complete, accurate, or clinically meaningful for any particular person.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the service is limited to the greater of the amounts you paid us in the twelve months before the claim arose, or one hundred US dollars.
Some jurisdictions do not allow certain limitations, in which case they apply to you only to the extent permitted.
14. Indemnity
You agree to indemnify and hold us harmless from claims, damages, and reasonable costs arising from your use of the service, your breach of these terms, your professional services, or your failure to obtain the consents and rights required for data you submit.
15. Changes to these terms
We may update these terms. If a change is material we will give notice by email or in the app before it takes effect. Continuing to use the service after that means you accept the updated terms. The effective date at the top of this page always reflects the current version.
16. Governing law and disputes
These terms are governed by the laws of the State of [governing state], without regard to its conflict of laws rules. The courts located in [venue] have exclusive jurisdiction over any dispute, and you and we each consent to that jurisdiction.
